These Terms of Service ("Terms") are an agreement between you and Pixhelm LTD ("Lobbix", "we", "us"), and govern your use of the Lobbix platform and the data we host on your behalf. By creating an account or using Lobbix you agree to these Terms.
Acceptance of terms
By accessing or using Lobbix you confirm that you can form a binding contract, that you are not barred from using the service under applicable law, and that you accept these Terms and our Privacy Policy. If you use Lobbix on behalf of an organisation, you represent that you are authorised to bind that organisation.
Description of the service
Lobbix is a cloud hotel management platform. It holds your property's reservations, guest records, folios, invoices and operational data, syncs availability and rates with the booking channels you connect, and serves the booking, billing and reporting workflows your team uses to run the property.
Accounts
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly at hello@lobbix.org if you suspect unauthorised access. You are responsible for the actions of everyone you invite to your workspace.
Acceptable use
You agree not to use Lobbix to:
- store or distribute illegal, harmful, deceptive, or malicious content;
- conduct phishing, distribute malware, or facilitate fraud;
- impersonate any person or organisation, or misrepresent your affiliation;
- infringe intellectual property, privacy, or other rights of others;
- circumvent plan limits, probe or disrupt the service, or attempt unauthorised access;
- send unsolicited or unlawful communications to guests through the platform.
We may suspend accounts that violate this section, with or without notice where the risk warrants it.
Your content
You retain ownership of the data you and your property create in the platform — reservations, guest records, rates, content and files. You grant us a worldwide, non-exclusive licence to host, store, and process that data solely to operate and provide the service to you. You are responsible for ensuring you have the right to hold the guest data you manage and that your use of it complies with applicable law and these Terms.
Plans, billing, and cancellation
Paid plans and their limits are described on our pricing page. Payments are processed by Paddle acting as our Merchant of Record; your purchase is also subject to Paddle's buyer terms. Fees are charged in advance for the billing period and, except where required by law, are non-refundable. You can cancel at any time.
Cancellation is non-destructive: your subscription runs to the end of the period you paid for, and your data — reservations, guests, invoices — remains exportable. We do not hold your data hostage to force an upgrade. Some modules and higher limits are available only on specific plans.
Intellectual property
Lobbix, its software, design, and trademarks are owned by us or our licensors and are protected by law. These Terms grant you a limited, revocable, non-transferable right to use the service; they do not transfer any of our intellectual property to you.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that reports and third-party channel syncs are complete or exact.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service will not exceed the amounts you paid to us in the 12 months preceding the event giving rise to the claim.
Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the service, or your breach of these Terms or applicable law.
Termination
You may stop using Lobbix and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the service or other users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
Governing law and changes
These Terms are governed by the laws of the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, and the courts of that jurisdiction will have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your country of residence. We may update these Terms; when we make material changes we will update the date below and, where appropriate, notify you. Continued use after an update means you accept the revised Terms.
